ASSEMBLY

Unless otherwise stated, Pool, Air Hockey, Soccer/Foosball, Table Tennis, Arcade Machine, Dual Tables may not come pre-assembled.

Therefore contact ATS office on info@alltablesports.com.au, or 03 9553 1418 if you require information regarding specific item assembly.

CUSTOMER SERVICE

All Table Sports Australia is committed to providing exceptional customer service and quality products. In the event that an ordered item is not available or we are unable to fulfil your order we will notify you within 5 business days to arrange an agreeable alternative item, a backorder or a full refund. 

TRANSPORT INSURANCE

When any bulk goods are shipped by third party courier, a 5% transport insurance levy on the value of the product will be applied.

CHANGES TO TERMS

Because of frequent changes in Internet technology and applicable law we reserve the right to make changes to these Terms and Conditions at any time that technology and legal changes require. You should check these Terms and Conditions regularly for such changes.

PRODUCT DESCRIPTION AND AVAILABILITY

We and any other persons involved in the management of this website may make changes in the products and prices described, and to other content of this website, at any time without notice.

We take all reasonable measures to ensure that details, measurements and descriptions of the products given on this Site are as accurate and complete as possible but there may be variations between these and the products supplied for an Online Purchase. We do not warrant that the product descriptions are complete or error-free. We reserve the right to correct such inaccuracies or typographical errors as they are identified.

All depictions contained on the website are for illustration purposes only. Actual products supplied may be slightly different in size, colour or shape.

All products are subject to availability. 

PRODUCT PRICES

The price displayed for products on this website represents the full price, including GST, for the product itself but does not include postage/delivery charges which will depend on the destination.

We always seek to provide products at the most competitive prices, and reserve the right to change prices displayed for products on our website at any time.

INTERNATIONAL SALES

We sell products world wide. For bulk items, customer needs to arrange their own shipment of the goods; item can be collected from our warehouse, or at Melbourne or Sydney port.

AGE RESTRICTIONS

You must be at least eighteen (18) years of age to place an order with us. We do not knowingly accept orders from anyone under 18.

By placing an order with us through this website you acknowledge that you are over eighteen (18) years of age.

Should we suffer any loss or damage as a result of a transaction entered into by a person under the age of 18, we reserve the right to seek compensation for such loss or damage from the parents or guardians of the person who placed the order(s) with us.

YOUR ACCOUNT

To purchase from us you must establish an account on this website.

We retain absolute discretion to refuse to allow an account to be established, to terminate accounts, to remove or edit content where the account has not been kept in accordance with these terms and conditions.

It is your responsibility to provide your exact email address, delivery address, billing address and telephone number. Any incorrect information provided may lead to a delay in delivering the product ordered by you or non delivery of the product.

You are responsible for the confidentiality of your account password. Your password and account details are stored on a secure server for ease of use in processing future orders or for warranty claims. The information is only used to process your orders, for statistical purposes that may improve our website and its services, and to allow us to notify you of special offers or new products via our newsletters. Please refer to our Privacy Statement on this website. No credit card details are stored by us.

SECURITY

When you register your personal details to establish an account or to place an order, a secure server is used. Secure Sockets Layer (SSL) encrypts the information you send through this website. We make no warranty in respect of the strength or effectiveness of that encryption and accept no responsibility for events arising from unauthorised access of the information you provide.

CONTRACT OF SALE

These terms together with your order constitute the entire contract between you and us for the supply of products. No other terms will apply except where terms may be implied by law. The contract cannot be varied unless we agree to vary it in writing or by email.

ORDERING PRODUCT

You can place an order only by clicking the "Add to Cart" button.

When you place an order with us you have made an offer to purchase the product you have chosen and when we issue a tax invoice to you we have accepted your offer. Both offer and acceptance are based on these terms and conditions.

We will issue you with an Order Number by email after we have received your offer to purchase.

We will notify you when we process your order by sending you an Order Confirmation and tax invoice via email. In order to prevent credit card or payment fraud your offer can only be accepted by us after it has passed our validation procedures.

We retain discretion to cancel orders if our processes identify any attempt at fraud or for any other legitimate reason.

If for any reason we cannot process or accept your order after payment is received, we will contact you by email or telephone to determine your requirements for the reimbursement of money paid.

PAYMENT METHOD

We only accept payment through Bank Transfer,PayPal and Credit cards (Visa and Master) via Paypal or ring us. A 1% surcharge will apply for Paypal / credit card (Visa and Master) / American Express. All payments are to be in Australian Dollars.

Payment will not be processed until we have received all relevant information required for processing to be completed.

The processing of payment for Orders placed on a weekend or a Public holiday will not begin until the next working day.

  • PayPal

We process PayPal payments when you checkout from the product order screen.

  • Bank Transfer/Deposit

Where you pay by Bank Transfer, you must pay the price payable as indicated on your Order Confirmation within 7 days from the date that you receive your Order Confirmation. Please note that BPAY payments take up to 2 working days to process.

 We retain absolute discretion to cancel the transaction if a payment is not received by us within 7 days from the date that you receive your Order Confirmation.

You must retain your tax invoice as proof of purchase.

We accept VISA or MASTER Cards via secure payment gateway or visit us.

Please note: goods will not be dispatched, delivered or installed until payments has been received in full by All Table Sports.

DISCLAIMER

Company gives no warranties of any kind (whether express or implied) in relation to any Online Purchase products.  Company acknowledges that the products supplied to you come with guarantees under the Australian Consumer Law that cannot be excluded.

Company will not be liable for any loss resulting from any action or decision by you in reliance on the PayPal payment method or any other third party security codes used on this Site for your Online Purchase.

LIMITATION OF LIABILITY

Under no circumstances, including, but not limited to, the Company's negligence, shall the Company be liable for any consequential, direct, incidental, indirect, punitive, or special damages that result from (A) an Online Purchase, (B) the delivery of Online Purchase products, (C) or the failure to deliver Online Purchase products, even if the Company or an authorized representative of the Company has been advised of the possibility of such damages. To the extent that the Competition & Consumer Act, 2010 ("Act") does not allow the exclusion or limitation of consequential or incidental damages, the above limitation or exclusion may not fully apply to you. In no event shall the Company's total liability to you for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) exceed AUD$1.00.

Without limitation to the foregoing (including the Disclaimer section of these Terms of Use), Company’s liability, if any, for any breach of a condition, warranty or guarantee implied by the Act, which cannot be excluded, is limited to any one or more of the following as determined by Company in its absolute discretion:

a. in the case of goods, the replacement or repair of the goods or the supply of equivalent goods; or the payment of the cost of repairing the goods or of supplying equivalent goods; and

b. in the case of services, the supply of the service again; or the payment of the cost of having those services supplied again.

INDEMNITY

You agree to indemnify and keep indemnified Company from and against any costs, loss, liability, claim or damage which Company incurs or suffers as a result of any default by you in respect of these Terms of Sale or of any act or omission by you in connection with your use of the Site.

TERMINATION

The Company reserves the right to terminate any Online Purchase upon notice before delivery of the Online Purchase product. Company will reimburse you the purchase price of the Online Purchase product if Company terminates your Online Purchase.

GENERAL PROVISIONS

These Terms of Sale and any additional terms posted on the Site together constitute the entire agreement between the Company and you with respect to your Online Purchase. No waiver of any obligation by the Company will be effective unless in writing and executed by the Company.  If, for any reason, a court of competent jurisdiction finds any provision of these Terms of Sale, or any portion thereof, to be unenforceable, that provision or portion shall be deemed severable, and shall not affect the validity and enforceability of any remaining provision of these Terms of Sale. These Terms of Sale shall be governed by and construed in accordance with the laws of Victoria, Australia, without reference to its conflicts of law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria and any courts of appeal from them for determining any dispute concerning these Terms of Sale. The Company reserves the right to commence proceedings in any jurisdiction and under the law of that jurisdiction in order to enforce its rights under these Terms of Sale.
